Should I write my own Will?

Writing your own will causes headaches down the line

Why can't I write my own Will. Issues outlining why you should not write your own Will.

Your Will should be properly executed and witnessed. If this is not done in accordance with the Succession Act 1965 the Probate Officer of the High Court or the Court itself will declare that the will is invalid.
Have you thought about the spouses Legal Right share? The right of a child to apply to Court to have proper provision made for them where no such provision is made? Creating trusts for potential minor beneficiaries? The doctrines of duress and undue influence? The capacity of the person making the will? Just a few issues you may have over looked

There are also rules that are applied in relation to the construction of a will after you have died which could give rise to a completely different interpretation unless it is done correctly. There is the Hotchpotch rule in relation to gifts advanced during the Will maker’s life time that can be taken into account and that can give rise to disputes.

That is before you get into the area of the effect of Capital Acquisitions tax or Inheritance Tax. Your will needs to be tax efficient otherwise your assets could end up going more to the Revenue than to the intended beneficiary.

Other areas that can cause problems are gifts of houses subject to a person not marrying another which are contrary to public policy and other gifts that might go against public policy which might not be to the forefront of a lay draftsman's mind.

Most disputes end up in the High Court or the Circuit court and the legal costs involved in the disputes on their own could well dissipate a good portion of the estate thereby frustrating the intention of the person making the Will.

To conclude making a homemade will may not be the wisest course of action. It might prove pennywise and in the long run pound foolish.

Nothing is certain in life

and facing up to this uncertainty is something we all must do. This is why you are never too young to draft your will. We will make the job of writing your will as comfortable and stress free as possible and when you’ve done it you will feel good about yourself for ensuring that your family and friends each get a piece of your legacy when you are no longer around. Drafting a will can be a weight off your shoulders. So why not contact us today and avail of our expertise in this area.

Sometimes disputes arise in connection with a will which can lead to 'claims against the estate' e.g. if a child or spouse has been left out of a will, if the will has not been properly executed or if there was fraud involved in the making of a will. These situations can lead to particular cases coming before the courts. Whether we are defending the estate or pursuing the claim against it we will see it through to the end, and act jealously to protect your best interests.

We understand that such situations can be stressful and can lead to tensions between those involved. This is why we act always with tact and sensitivity. We’ve been doing this for a long time now and we know how to handle our cases and treat our clients.
